[b]“福彩”被注册成饲料商标，天朝福利彩票[/b][b]发行管理中心对此不满，认为“福彩”二字已是公众认可的福利彩票的“简称”，因此将国家商评委告上法院，要求撤销该商标注册。[/b]
9 H1 Q! x$ [& J[p=30, 2, left] 记者今日获悉，这起商标纠纷案日前已在北京市一中院开庭审理。[/p][p=30, 2, left] 2004年10月8日，广西一家饲料公司在饲料等商品类别上提出了商标“福彩FUCAI及图”的注册申请。[/p][p=30, 2, left] 在商标申请异议期内，天朝福彩中心提出异议，该中心认为，“福彩”是福彩中心名称的知名简称，自该中心成立以来，其上级部门财政部就一直在下发的文件中将其简称为“中福彩中心”。[/p][p=30, 2, left] 同时，天朝福彩中心还认为，“福彩”也是福利彩票的简称，是天朝福彩中心在全国范围内拥有独家经营权利的经营项目的简称。经过多年的宣传，“福彩”品牌已为广大公众所熟知，应属于天朝福彩中心一直持续使用的未注册商标。[/p][p=30, 2, left] 天朝福彩中心认为“福彩FUCAI及图”商标违反了《商标法》的规定，不应予以核准注册。[/p][p=30, 2, left] 对于天朝福彩中心的异议，商评委经审查后认为，天朝福彩中心没有提供证据证明“福彩”是其企业名称的简称或字号，在案证据也不足以证明，在“福彩FUCAI及图”商标申请注册之前，“福彩”无论是作为字号还是作为商标，在饲料等相同或类似商品上已经使用并具有一定知名度，因此裁定该商标核准注册。[/p][p=30, 2, left] 天朝福彩中心不服商评委该裁定，向北京一中院起诉要求撤销商评委的裁定，并重新作出裁定。[/p][p=30, 2, left][b] 双方观点[/b][/p][p=30, 2, left] 开庭过程中，天朝福彩中心表示，福利彩票在称谓上相对繁琐，因此大家习惯表达为“福彩”，已成为福利彩票公认的简称，当社会公众提到福彩时，只能联想到天朝福利彩票。[/p][p=30, 2, left] 对此，商评委答辩称，该委作出的上述裁定程序合法，适用法律正确，请求法院予以维持裁定。[/p][p=30, 2, left] 法制晚报记者 王巍[/p] |
