合作挖矿丢设备索赔诉讼，中国湖南省法院判虚拟货币相关合同无效，损失自担

比推消息，近日，中国湖南省桂阳县人民法院就审结一起涉虚拟货币挖矿合同纠纷案件，原告胡某与他人合作开展虚拟货币挖矿活动，后因挖矿设备丢失，诉至法院要求返还 57 万元出资款，法院依法判决驳回原告胡某的全部诉讼请求。
胡某与周某系朋友关系。某科技公司成立于 2021 年 5 月，周某为股东之一，李某、彭某则通过关联关系参与公司挖矿业务。双方商定合作挖矿，胡某通过虚拟货币 APP 向周某支付 55000 美元（双方认可折合人民币 357082 元），另委托曹某向周某银行转账 198000 元，合计 555082 元，全部用于购买服务器、硬盘等挖矿设备，设备由科技公司托管运营。2022 年 7 月，设备转移至周某家厨房存放，胡某此后仅向周某支付电费。2023 年 11 月，李某因与周某存在经济纠纷，拆走部分硬盘。虽经派出所调解，李某归还 82 块硬盘，但胡某主张仍有硬盘丢失，双方协商无果。2024 年，胡某以设备丢失为由起诉四被告，要求返还 57 万元出资款。
法院审理后认为，根据中国人民银行等十家部门联合发布的《关于进一步防范和处置虚拟货币交易炒作风险的通知》第一条载明：虚拟货币不具有与法定货币等同的法律地位，不具有法偿性，不应且不能作为货币在市场上流通使用。虚拟货币相关业务活动属于非法金融活动。参与虚拟货币投资交易活动存在法律风险。任何法人、非法人组织和自然人投资虚拟货币及相关衍生品，违背公序良俗，相关民事法律行为无效，由此引发的损失由其自行承担。本案中，胡某委托购置的设备用于挖矿，以虚拟货币支付款项、结算管理费，损害法定货币地位，违背公序良俗。案涉委托合同应认定为无效。
