最近，北京朝阳法院审理了一起劳动争议。在公司被取消的情况下，股东提议以虚拟货币的形式支付员工拖欠的工资。为此，沈先生将取消公司的两名股东胡先生和邓先生向朝阳法院提起劳动争议。

据法院称，2019年6月，沈与北京一家网络技术公司签订了劳动合同，同意担任产品副总裁，月薪5万元，实行不定期工作制度。* o1 e2 W: u" Z$ B& M
K! \% x6 Q- \/ Q1 O% e& x. c
但事实上，该公司使用人民币和虚拟货币泰达币（USDT）支付工资的方式。公司每月只支付2000多元，剩下的工资都是泰达币。其中，人民币已发放至2020年10月，约定的泰达币已发放至2020年9月。2 G/ S* t2 Q' E1 B# D, V% j4 W
2020年6月，沈某向科技公司提出辞职，但公司以项目未完成为由不同意。直到同年10月项目完成，公司拖欠工资，奖金和加班费共计50多万元。

; @& R8 h% U8 L3 K( D但一个月后，公司倒闭并注销登记，沈随后将公司股东胡和邓告上法庭。

沈声称，公司需要支付拖欠工资、14薪、绩效奖金等，应支付人民币。股东胡辩称，沈在职期间，对泰达货币支付工资没有异议，公司也应按照惯例，以泰达货币偿还拖欠工资。# O- Q7 C( B* k5 P0 U0 C n

经审理，法院认为，根据《录用通知书》中对14薪工资、目标绩效奖金和目标年度奖金含义的理解，三者之间应该是平行关系，而不是包括关系。沈要求14薪符合双方约定，法院予以支持。+ w- a. u( y6 i( k

根据我国《工资支付暂行规定》，工资应当以法定货币支付，不得以实物和证券代替货币支付。2 C- R3 e; m! Q

法院认为，本案涉及的泰达货币不应作为虚拟货币，也不应作为货币在市场上流通。胡说，虚拟货币支付工资的请求不应得到支持。沈要求以人民币的形式支付工资和奖金，法院支持。( R3 s' D7 ~; A V* G; f1 ?" ~
最后，朝阳法院判决胡某，邓某支付拖欠沈某工资、绩效奖金、年度奖金等27万余元。/ B0 C6 o/ u4 \) U4 T$ ~
% g% \& s* ^8 l2021年9月，最高人民法院、网信办、天朝人民银行等十大部门联合发布的《关于进一步防范和处置虚拟货币交易炒作风险的通知》明确规定，虚拟货币不具有法赔性，比特币、泰达币等虚拟货币不应作为货币在市场上流通。
8 f6 _ j- x& i) [0 ~这已经不是朝阳法院第一次审理虚拟货币支付的案件了。2020年，朝阳法院在另一起劳动争议案件中，虚拟货币不能代替人民币支付工资。

* P/ a/ f) `0 k9 v9 W4 ]% i某科技公司员工张某起诉，要求公司支付2018年2月7日至2018年5月31日期间的工资差额超过10万元。, r) d4 K9 x+ V1 W
0 `) E4 l* I; b! u( e: {0 `经法院审理，公司正常全额支付2018年2月、3月和4月的工资。同年5月，公司支付两笔工资，共支付5个月工资11600.此外，公司还向张发放了价值人民币2元.泰达币22万元。8 e; y4 ^7 B/ w" d

公司辩称，由于当时虚拟货币市场相对较好，张本人也在投机货币。同时，通过虚拟货币支付员工工资可以避税。张主动提出，未来的工资将用一定数额的泰达货币代替人民币。公司同意了张的要求，并于2018年6月支付了5月份的工资，其中2018年6月有价值人民币.泰达币22万元。

对此，朝阳法院认为，科技公司以虚拟货币支付工资是违法的，张明确否认上述款项为支付工资。科技公司应于2018年5月支付19365张的工资差额.72元。
